Custody and Guardianship
Guardianship is a bundle of rights and powers that an adult has in relation to the person and property of a minor. In simple terms, a person who has legal custody over your child. In UAE, if a father dies without a Will mentioning the guardianship then under Shariah Law the mother does not get children instead the Guardianship falls to the oldest living male relative on the paternal side. There are three types of guardianship documentation which a person can apply for in UAE; Civil guardianship agreement, a legalised documentation through the Dubai Courts System and a legalised documentation through the DIFC Courts System.
