Divorces
A divorce is a legal action between married people to terminate their marital relationship, also referred to as dissolution of marriage. In the UAE, Islamic marriages are governed by Sharia and will most likely be applied to their divorce if both husband and wife are Muslims and residents in the UAE or if the husband is Muslim and the woman is a non-Muslim. Non-Muslim expatriate residents can file for divorce in their home country or apply for divorce in the UAE. The parties involved can also wish to have the law of their home country applied by petitioning for this before the court. If the law of the parties’ home country fails to cover an aspect of the divorce procedure, the courts hold discretion to apply the UAE law. Depending on the complexity of the case, divorces in the UAE can take anywhere between three to six months, sometimes more, however a mutual consent divorce in the UAE can take place within a month. In terms of Sharia, for a divorce to take place, the judge must be fully convinced the marriage will not work and thereby, can be difficult to arrange for separation
