Last Will & Testament

A will, also referred to as a last will and testament, is a document through which the person making the will, known as the testator, express their wishes as to how their assets are to be distributed after their lifetime. A will generally includes the appointment of executors, beneficiaries & instructions on how & when they will receive the assets and guardians for any minor children. It is of utmost importance for any person to make a will because it ensures your last wishes are honoured regarding the manner your assets are to be distributed.

In the UAE, a will is of utmost importance for clients that do not adhere in the Islamic / Sharia practices. The Government of United Arab Emirates has strived to create a conducive environment for its large expatriate population in order to retain their talents and to attract brighter minds. For this, there have been innumerable amendments to the law to cater to expatriate population. One such amendment is permitting expatriates to make wills as per the laws prevalent in their home country. If a Will exists, UAE law permits a person to opt for the law of their Domicile Home Country to be applied to the distribution of their UAE assets. If a person passes away intestate, Sharia will be applicable as per the local laws of UAE. The Dubai Courts, Abu Dhabi Judicial Department and DIFC all provide notarization services that allows people to authenticate their wills.
